Hi I would like to know the procedure which has to be followed for getting a logo registered for my company as I am going to start a company in near future?

A logo is a sign, which can discriminate the services & goods from those of other traders and gives one an exclusive right to use it. The logo registration will avert third parties from using, without consent, similar logo for similar goods & services as those protected by registering your logo in India. Logo Registration Process • Search of Logo The first step of logo registration process is to find out whether the intended logo is existing for registration or not.. • Filling of Logo Registration Application Filing of Logo registration submission is the second step in Logo Registration after getting the positive search report. After receiving of the acknowledgement the applicant can use the symbol TM along with the applied Logo. • Examination of Logo Registration Application Issuance of examination statement by the Registration office is the third step in the Logo Registration. Upon receipt of Logo registration submission, the Registrar issues an examination report after examining the application. • Publication of Logo in Trademark Journal Fourth step in the Logo registration process is the publication of the Logo in the Trademark journal. If the Registrar considers the mark as a distinguishing Logo or after the removal of the objections, if any, raised by the Registrar he may cause the application to be advertised in Trademark journal. • Logo Registration Certificate Issuance of Trademark registration certificate is the fifth step in the Logo Registration. After the application for Registration of Logo is established by the Registrar, the Registrar shall issue to the applicant a Certificate of Registration beneath the seal of the Trademark Registry. |
